Г-да посланици, намесете се! Спрете прокурорския произвол!

Ваши Превъзходителства, посланици на страните, членки на ЕС, САЩ, Русия, Китай и Великобритания. Обръщам се към вас, тъй като ситуацията в България по отношение на правосъдната и правораздавателната система се влошава.
 
Българските политици са заети с преговори за участието си и извличане на изгоди от властта, а не с проблемите на обществото. Освен това знаем пасивността им по отношение на борбата с корупцията и реформите в магистратурата.

Хората са демотивирани, а броят на трайно напускащите България се увеличава. На ръба сме на демографска и институционална криза.

 

Цяла седмица вече обществото се тресе от скандала около срещата между главния прокурор Сотир Цацаров и бизнесмените Георги Гергов и Сашо Дончев. За да се опита да тушира възникналия „пожар” по случая и да прикрие намесата на обвинението в полиитката и бизнеса, Главна прокуратура стартира спешно шумни акции. Което предизвиква задаването на няколко очевидни въпроса.

 

По казусът „ЦУМ-прокурор и газ”:

 

- Г-н Цацаров твърди, че срещата е била по настояване на г-н Дончев. Защо тогава г-н Цацаров като висш магистрат се е съгласил да участва? Това не уронва ли престижа на институцията и не нарушава ли моралния кодекс (такъв май няма)?

 

- Г-н Цацаров твърди, че г-н Дончев го е заплашвал и му е оказвал натиск по време на срещата, а не обратното, както разказва газовия предприемач. Защо тогава г-н Цацаров е търпял това унижение, не е ударил по масата и не е напуснал офиса на г-н Гергов в ЦУМ?

 

- Г-н Цацаров заяви вече, че тези неща са се случили както той казва и няма да повтаря повече позицията си. Но ние, като граждани, се питаме: Защо г-н Цацаров не огласи веднага след срещата как стоят нещата, а остави инициативата в ръцете на г-н Дончев? От страх? От скромност? Поради заетост по планиране на грандиозни акции срещу престъпността?

 

- След като вече няма съмнение, че такава среща се е провела, можем ли да допуснем, че главният проукрор е участвал и в други подобни, с други участници?

 

Г-жа Арнаудова, говорителката на г-н Цацаров от ден и половина е пред камерите. Повод за поредната й изява е нахлуването на прокурори и дансаджии в Пътната агенция. Но пропусна да спомене, че акцията е по сигнал на ОЛАФ – Европейската служба за борба с измамите. Именно тази служба е уведомила властите в България, в това число и държавното обвинение, за корупционната схема, разиграла се при строителството на магистрала „Марица”.  Не е ли работа на ДАНС и прокуратурата да зная тези неща от свои източници и проверки, а не да чакат ОЛАФ да ги снабдява с нужната информация и документи? Освен това знаем как завършват делата у нас, свързани с ОЛАФ...

 

За шумната акция в Плевен също има доста въпросителни. Дейността на задържаните лица не е някаква тайна. Липсва обаче конкретика в обвиненията, обещава се тепърва да се търсят доказателства и свидетели. Това е доста странно. Възикват съмнения, дали сегашните фойерверки не са предназначени: А/ да се посочи какво става в град, където кметът не е от ГЕРБ; Б/ да се заглуши скандалът „Цацаров – ЦУМ – газ”?

 

Към подобни мисли навеждат и активните изяви на председателя на Специализираната прокуратура г-н Иван Гешев. Той сякаш иска да ни внуши, че близкото обкръжение на главния прокурор, е сплотено и силно като юмрук. Железен юмрук. 

 

Ваши Превъзходителства! Българските граждани няма да се вдигнат на протести срещу своеволията на държавното обвинение и очевидният диктат на прокуратурата. Особеност на националния характер на българина е „да не се самосезира” за злото, докато то не го засегне лично. Не сме като поляци, унгарци, французи, румънци, сърби, гърци, италианци и пр., които защитават правата и свободата си с протести. Ние сме свикнали с малко права и с още по-малко свобода...

 

Няма да ви занимавам сега със случаите на репресивни действия от страна на прокуратурата към бизнесмени, журналисти и граждани, които критикуват властта и действията на магистратурата. Вие ги знаете.

 

Ще припомня само, че недоверието в държавното обвинение е 94%, а доверието – 6%. Най-ниско в цяла Европа! Затова пък сме първи по корупция не само в Европа, но и в голяма част от останалия свят.

 

Молбата ми е да предприемете действия за промяна на положението в България. Без да се намесвате във вътрешните ни работи, защото сме суверенна държава. Тоест бяхме, сега сме окупирана: от мафията в съюз с прокуратурата. Дали ще настоявате да се изпратят тук европейски наблюдатели-магистрати, за извършване на независима проверка на споменатите случаи или ще призовете да се започнат радикални реформи – все едно. Но направете нещо, защото повече така не се живее.

Dear Ambassadors, please take action! Stop the prosecutor's arbitrariness!

 

Your Excellencies, Ambassadors of the EU Member States, the United States, Russia, China and the United Kingdom. I address you by this letter because the situation in Bulgaria in terms of the justice and judiciary system is getting worse. Bulgarian politicians are busy negotiating for their participation and profiting from the government power and they neglect the problems of society. Furthermore, we know their passive attitude towards the fight against corruption and the reforms in the magistrate system.

 

People are demotivated and the number of people permanently leaving Bulgaria is increasing. We stand at the brink of demographic and institutional crisis.

 

For a whole week now, the society is shaken by the scandal concerning the meeting between the Prosecutor General Sotir Tsatsarov and the businessmen Georgi Gergov and Sasho Donchev. In order to try to extinguish the "fire" of this case and to conceal the interference of the prosecution in the political and business sector, the Prosecutor General's Office launched urgently noisy actions, which brought a number of obvious questions.

 

With regard to the case “TZUM-Prosecutor and gas”:

 

- Mr. Tsatsarov said the meeting was held at the insistence of Mr. Donchev. Why, then, Mr. Tsatsarov as a senior magistrate has agreed to attend such meeting? Does not this damage the prestige of the institution and does not this violate the moral code (probably such code does not exist)?

 

- Mr. Tsatsarov said that Mr. Donchev threatened him and put pressure on him at the meeting, not the opposite, as the gas entrepreneur pointed out. Why, then, did Mr. Tzatsarov have suffered this humiliation, and why did not he oppose and leave Mr. Gergov's office in TZUM?

 

- Mr. Tsatsarov has already said that those things happened as he said and he would not repeat his position any further. But we, as citizens, are asking: Why did not Mr. Tsatsarov immediately announce after the meeting how things were but he left that initiative in the hands of Mr. Donchev? Did he do that because of fear? Or because of modesty? Or because of the planning grand actions against crime?

 

- Now that there is no doubt that such a meeting has taken place, can we assume that the Prosecutor General has participated in other similar events with other participants?

 

For the day and a half now, Mrs. Arnaudova, the spokesperson of Mr. Tsatsarov is giving statements in front of the cameras. The reason for her latest appearance is the invasion of prosecutors and officials of SANS  at the Road Agency. But she failed to mention that the actions had been taken after a signal was filed by OLAF - the European Anti-Fraud Office. It was this office that informed the authorities in Bulgaria, including the state prosecution, about the corruption scheme that took place during the construction of Maritsa highway. Is not it within the scope of obligations of SANS and the Prosecution Office to know such things from their own sources and investigations, but not to wait for OLAF to supply them with the necessary information and documents? Furthermore, we know how the cases related to OLAF are being closed in our country…

 

There is also a lot of questioning about the noisy action taken place in the town of Pleven. The activities of the persons detained are no secret. However, there are no concrete and specific accusations, rather it was promised to proceed with searching for evidence and witnesses. This is quite strange. There are doubts whether the current fireworks are not intended (i) to indicate what is happening in a town where the mayor is not from GERB; and (i) to silence the scandal "Tsatsarov - TZUM - gas"?

 

Similar thoughts are also brought by the active speeches of the Chairman of the Specialized Prosecutor's Office, Mr. Ivan Geshev. It seems that he wants us to believe that the close environment of the Prosecutor General is cohesive and strong like a fist. Like an iron fist.

 

Your Excellencies! Bulgarian citizens will not go out protesting in the streets against the arbitrariness of the state prosecution and the obvious dictate of the Prosecution Office. The peculiarity of the national character of the Bulgarians is "they do not get involved" about the bad thing happening unless they such things do not affect them personally. We are not like Polish, Hungarians, Frenchmen, Romanians, Serbs, Greeks, Italians, etc., who protect their rights and freedom by going out protesting in the streets. We are used to limited rights and even less freedom...

 

I will not bother you now with cases of repressive actions taken by the Prosecution Office against businessmen, journalists and citizens who criticize the authority and actions of the magistrate system. You know them.

 

I will only recall that the mistrust in the state prosecution is 94%, and the confidence - 6%. We have the lowest percentage across Europe! We, therefore, take the first place for corruption not only in Europe but also compared to many other countries in the world.

 

My request is to take action to change the situation in Bulgaria. Without interfering with our internal affairs because we are a sovereign state. Meaning, we were, because we are now occupied: by the mafia in alliance with the Prosecutor's Office. It does not matter whether you will insist that European observer-magistrates be sent here to carry out an independent investigation of those cases, or you will call for radical reforms to be initiated. But please do something because we cannot live like that anymore.
