Синдик Даниела Куцева до ЕК: Имаше заговор срещу КТБ и Цветан Василев

Даниела Куцева е синдик от Министрество на правосъдието. Ето какво се казва в писмото й до ЕК:

В хода на моите действия, в качеството ми на синдик, съм станала свидетел на действията на фигури от българския политически елит, като съм виждала как

се упражнява натиск върху съда и синдика по отношение на предприемането

на определени процесуални действия по конкретни дела за несъстоятелност, с

цел обслужване интересите на една определена партия в съдебния процес.

През 2014 год. бях назначена от Софийски градски съд /СГС/ на няколко юридически лица, които бяха от особен интерес за определени фигури от политическия елит в Република България.

Едно от тези дружества е "Технологичен център-Институт по микроелектроника (ТЦ-ИМЕ)" АД, познат на публиката като един от субектите, контролиран от банкера

Цветан Василев.

При поемането на това задължение, бях извикана от Председателя на СГС

Владимира Янева, на която среща тя ми обясни, че посочената по-горе компания

е особено важна за депутата Делян Пеевски. Поради тази причина всички мои

действия в хода на процедурата по несъстоятелност трябваше да се

предприемат, само, след изричните заповеди и инструкции, дадени от самия

Делян Пеевски.

Стана ми ясно, че е на път да избухне публична война между Пеевски и

мажоритарния собственик на КТБ-Цветан Василев. Със започването на процедурата по несъстоятелност Пеевски искаше да поеме управлението върху "Технологичен център-Институт по микроелектроника (ТЦ-ИМЕ)" АД, както и да причини значителни щети на Цветан Василев и КТБ.

Заради оказания ми натиск и сплашване, извърших действия, с които изрично не

съм съгласна. Ако не се съгласявах с исканията на Пеевски и Янева, ми се демонстрираше сила и агресивност на действащата държавна машина, която наказва непокорните.

И накрая, но не на последно място, трябва да спомена, че лично присъствах

на срещата с Теодора Танева, изпълнителен директор на "Технологичен център-Институт по микроелектроника (ТЦ-ИМЕ)" АД, Бисер Лазов и адв.

Александър Ангелов, известен като адвоката на Делян Пеевски. Целта на

срещата беше да се обсъдят различните варианти за източване на активите на

дружеството и придобиване на други фирми, контролирани от Цветан Василев.

На тази среща бяха обсъдени и възможните действия, свързани с промените в борда на директорите на БТК и надзорния съвет, като тези методи, мога да ги определя, единствено с методите, използвани през 90-те години.

В тези срещи, участниците многократно

обсъждаха развитието на производството по несъстоятелността върху КТБ и начина на разпределение, както и съдбата на акивите в банката.

Всичко това се извършва от политическия и икономически кръг,

близък до партията ДПС, които използват влиянието си в ключови области и

най-вече-съдебната система, Прокуратурата и ДАНС.

In course of my acting in the capacity of a bankruptcy manager, I have

become a witness of various figures` from the Bulgarian political elite

exerting a fundamental pressure on the court and the bankruptcy manager

in terms of undertaking certain procedural actions in particular

bankruptcy cases, with the aim of serving the interests of one

particular party in the judicial procedure.

As of early 2014 I was appointed by the Court of the City of Sofia as a

temporary bankruptcy manager of several entities, which were of a

particular interest to certain figures from the political elite of

Republic of Bulgaria.

One of such entities was TEHNOLOSHKI TZENTAR-INSTITUT ZA

MIKROELEKTRONIKI, known to the public as one of the entities controlled

by the banker TzvetanVassilev.

Upon my assuming of the duty of the bankruptcy manager of TCME, I was

summoned to a meeting by VladimiraJaneva, the President of the Court of

the City of Sofia, where I was explained that this company has been

particularly important for the Member of the Parliament ,DelyanPeevski,

wherefore all my actions in course of the bankruptcy proceeding need to

be undertaken only upon the explicit orders and instructions to be given

solely by DelyanPeevski.

It became clear to me in that meeting that a public war is about to

break out between Peevski and the majority owner of the Corporate

Commercial Bank-TzvetanVassilev.

By launching the bankruptcy proceeding and appointing a temporary

bankruptcy manager, DelyanPeevski would be managing to gain control over

TCME, and to cause significant damage to both Vassilev and KTB.

I have undertaken certain actions in spite of my explicit disagreement,

due to pressure and intimidation suggesting that otherwise there shall

be certain actions undertaken in order for me to be denied the right to

act as a bankruptcy manager.

My lack of willingness to issue consent to the above displeased in

particular the Prsident of the Court of the City of Sofia. What followed

was the waiving of fingers at me, aggressive behavior and intimidation

by my deprivation of the right to act as a bankruptcy manager.

At last, but not least, I should mention my presence in the meeting

organized withTeodorTanev, the Executive manager of TCME, BiserLazov and

AleksandarAngelov, known as the lawyer of DelyanPeevski.

The goal of the meeting was to discuss the different options for

pumping-out of company assets and takeover of other entities by

TzvetanVassilev.

In the meeting there were discussed possible actions related to change

of composition of BTK`s Board of Directors and Supervisory Board, which

resembled the one exerted in Bulgaria over the 1990s.

In those meetings, the participants have discussed on numerous

occasions the development of the bankruptcy proceeding over the KTB, and

the manner of distribution of its case, and the destiny of the bank`s

assets.

I am of the opinion that there is in progress an aggressive political

attempt of taking over the business from the banker TzvetanVassilev,

which is being undertaken by the political and economic circle

surrounding DPS, who are using the serious influence in the key areas,

such as the judiciary, Public Prosecutor`s Office, the National Security

etc.
